Information from www.state.nj.us. Second offense DWI charges apply if you have had another DWI charge in the past 10 years. Third offense DWI charges apply if you have had a second DWI offense in the last 10 years.
DUI with BAC greater than 0.08% but less than 0.10%
License loss : 3 months
Fines, fees & surcharges : $250–$400 fine, $230 IDRC* fee, $100 to drunk driving fund, $100 to AERF*, $1,000/year (for 3 years) surcharge, $75 to Neighborhood Services Fund
Prison Term: Up to 30 days
Community Service: 12–48 hours IDRC*

License loss : 7 months – 1 year
Fines, fees & surcharges : $250–$400 fine, $230 IDRC* fee, $100 to drunk driving fund, $100 to AERF*, $1,000/year (for 3 years) surcharge, $75 to Neighborhood Services Fund
Prison Term: Up to 30 days
Community Service: 12–48 hours IDRC*
2nd DWI Offense within 10 years
License loss : 2 years
Fines, fees & surcharges : $500–$1,000 fine, $280 IDRC* fee, $100 to drunk driving fund, $100 to AERF*, $1,000/year (for 3 years) surcharge, $75 to Neighborhood Services Fund
Prison Term: 48 hours–90 days
Community Service: 30 Days and 12–48 hours IDRC*
3rd DWI Offense within 10 years
License loss : 10 years
Fines, fees & surcharges : $1,000 fine, $280 IDRC* fee, $100 to drunk driving fund, $100 to AERF*, $1,500/year (for 3 years) surcharge, $75 to Neighborhood Services Fund
Prison Term: 180 days
Community Service: Up to 90 days (can reduce period of imprisonment) and 12–48 hours IDRC*
Driving While Possessing Drugs
License loss : 2 years
Fines, fees & surcharges : Minimum $50 Fine

*AERF – Alcohol Education and Rehabilitation Fund
Underage drinking may cause a six-month delay in getting a license. Alcohol and drug-related offenses require completion of an alcohol screening and evaluation program.
